Terms of Services

This is a legal Agreement between you and All Time Design. As a legit affiliate of All Time Design, you agree to accept the Terms and Conditions mentioned in this Agreement and you legally abide by each and every Term and Condition mentioned here.

Please read this entire Agreement carefully and if you want you may take a copy of this Agreement for your records.

Your association with All Time Design is solely for the purpose of legally promoting our services to receive a commission on memberships and services purchased by personals you recommended to All Time Design by your own website or personal promotions.

Please note that throughout this Agreement, “we,” “us,” and “our” stand for All Time Design and “you,” ‘your,” and “yours” refers to the Affiliate.

All Time Design reserves the right to accept or reject ANY Affiliate Program Application on our independent and absolute choice. You will never initiate any legal recourse against All Time Design for the dismissal of your Affiliate Program Application.

To enroll in All Time Design’s Affiliate program, you will submit a completed online application at All Time Design’s affiliate registration page. Your submitted application will then be reviewed and verified by an authorized representative from All Time Design in order to become our affiliate partner. All Time Design may reject your application if it,

2.1.1. Advertises sexually explicit content, violence, and illegal activities

2.1.2. Promotes discrimination based on race, sex, religion, nationality, disability, or age.

2.1.3. Promotes any materials that breach any copyright, trademark or other intellectual property rights or materials that violate the law.

2.1.4. Promotes any materials that cause an infringement of copyright or trademark

2.1.5 Promotes any unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically objectionable content.

2.1.6. Downloads malware software programs that may possibly cause deviations from other affiliates in our program.

2.1.7. Neither may you create or design your website, or any other website that you operate, in a manner that resembles our website nor may you design your website in a way that makes customers think you are All Time Design or another affiliated business.

2.2. As an authorized member of All Time Design’s affiliate, you will have an access to our exclusive portal where you can review our Program details, use an affiliate link and our approved marketing collaterals and keep a check on your earnings.

2.3. All Time Design reserves the right to review your placement and approve your use of affiliate links at any time, and may require that you change the placement or use in order to comply with the guidelines provided to you.

2.4. It will be your responsibility to maintain and update your affiliate content. In order to maintain the quality of your content and to notify you of any changes that we feel should enhance your performance, we may monitor your content as we feel necessary.

2.5. As the owner of your website, social profiles, and content, you are entirely responsible for adhering to all applicable intellectual property laws. To use anyone else's copyrighted material, be it a writing, an image, or any other form of copyrightable work, you must have obtained written permission from the concerned individual. We will not be liable for any use of another person's copyrighted material or intellectual property that violates the law or the rights of third parties (and you will be solely responsible for any such use).

3.1. All Time design has the right to review and monitor all the affiliate content anytime to determine if you are following the terms and conditions of this Agreement. You may be notified of any changes to your affiliate content that we feel should be made, or to ensure that your affiliate content is appropriate and to notify you further of any changes. If you do not make the changes to the content as per the feedback we shared, we may terminate your association with us immediately.

3.2. The company reserves the right to terminate this Agreement and your participation in the All Time Design’s Affiliate Program immediately and without notice any in the event that you violate this agreement or abuse the program in any way. In such instances, we shall not be liable to you for commissions for such fraudulent sales.

3.3. Upon acceptance of your Affiliate application, this Agreement will commence and continue until terminated.

Both the parties may end the Agreement at any time with or without any reason, by intimating another party with proper written notice. The notice can be in the form of an email, fax, or physical mail. But your association with All Time Design will be ended immediately upon any infringement or breach of this Agreement by you.

All Time Design holds the rights and responsibilities to modify any of the terms and conditions mentioned here in this Agreement at any time. You will be notified via email when any modifications to the Terms and Conditions are made. Amendments may include, but are not restricted to, changes in the payment process and All Time Design’s Affiliate Program rules. If you find any disagreeable rules in the modified Terms and Conditions, your only option is to opt your way out and end this Agreement. Your continued association with All Time Design, even after the modifications in the rules confirms your consent to the changes.

All Time Design manages all tracking and payment processes internally and it will be done via our own portal. Whereas, payments can be made only online.

You will get immediate access to our portal as soon as you are accepted as an affiliate by us and you will create a unique password to enter your portal. You can easily track reports that will give you clear calculations of your commissions.

8.1 You may promote your own websites on your own without any restrictions from us, but any promotions that include All Time Design could be recognized by the general public or the press as a combined effort. All Time Design restricts its affiliates from a certain form of promotions. Examples, spamming, unsolicited commercial emails, and promotions to non-commercial groups. You are also restricted from advertising in any way that conceals or misrepresents your identity, domain name, or your return email address. You may mail your customers to promote All Time Design as long as they are already your customers or subscribers of your product or services or websites. You should also leave the option for them to unsubscribe from your promotions at any time.

You may promote All Time Design’s services to a new group as long as there are no restrictions for commercial messages posted on the group. At all times, you must project yourself as an independent advertiser and not as an affiliate from All Time Design. If we found any evidence of spamming or misrepresentation of All Time Design, we will terminate your Agreement without any prior notification. On such events, If there be any outstanding balances, they will not be paid to you.

8.2. Affiliates who occasionally or exclusively bid in their Pay-Per-Click campaigns on keywords such as alltimedesign, alltimedesign.com, and/or misspellings or other variations of these - whether separately or in combination with other keywords - and do not direct the traffic generated from such campaigns to their own websites prior to redirecting it to All Time Design, will be considered trademark violators, and will be banned from All Time Design's Affiliate Program. We will do everything in our power to contact the affiliate before the ban is implemented. Nevertheless, we reserve the right to expel any trademark violator from our affiliate program without prior notice and on the first occurrence of such PPC bidding behavior.

8.3. Affiliates are not prohibited from entering prospects' information into the lead form, so long as the prospect's information is accurate, and these are valid leads (i.e. sincerely interested in All Time Design's services).

8.4. Affiliate shall not transmit any so-called “interstitials,” “ParasitewareTM,” “Parasitic Marketing,” “Shopping Assistance Applications,” “Toolbar Installations and Add-Ons,” and “Shopping Wallets” to consumers from the time the consumer clicks on a qualifying link until the time the end-user fully exits All Time Design’s site (i.e., no page from All Time Design's site, or any All Time Design branding, is visible). It may

(a) Intentionally or accidentally overwrites affiliate and nonaffiliate commission tracking cookies through any means other than a customer-initiated click on a qualifying link on a web page or email.

(b) A user would have normally arrived at the same destination through the search engine results (search engines include Google, MSN, Yahoo, Overture, AltaVista, Hotbot, and similar search engines); (b) intercepts searches to redirect traffic to an installed component that inserts pop-ups, commission tracking cookies, or other commission tracking cookies, instead of using the search engine results (for example, Google, MSN, Yahoo, Overture, AltaVista, HotBot, and similar search or directory engines);

(c) Set commission tracking cookies through All Time Design’s site loading in frames, hidden links, and pop-ups that automatically open All Time Design's site;

(d) The application uses contextual marketing to target text on websites other than those owned by the application's owner;

(e) Removing, replacing, or blocking the visibility of Affiliate banners with any other banners, other than those included on the owner's own websites.

PPC bidding is restricted and if you wish to run a PPC bid, you must get written consent from All Time Design.

10.1. All Time Design grants you non-exclusive and non-transferable ownership to,

(i) Access our website through HTML links in accordance with the terms of this Agreement and

(ii) Use our logos, trade names, trademarks, and similar marketing materials that we offer to you or authorize you to use. You are entitled to use these materials to the extent that you are a member of All Time Design’s Affiliate Program. You agree that all uses of the Licensed Materials will be for All Time Design and the goodwill associated with such uses will be to All Time Design's exclusive benefit.

10.2. Both parties agree not to disparage, misrepresent, obscenely depict, or otherwise disparage the other's proprietary materials. It is understood that this license is a nontransferable license, which means both parties reserve all of their respective rights.

All Time Design implies no representations or assurances regarding the services and website or the services offered therein, any implied warranties of All Time Design’s ability, purpose and non-infringement are disclaimed and excluded. Furthermore, we make no representation that the functioning of our website will be uninterrupted or errorfree. We will not be responsible for the consequences of any interruptions or errors.

You hereby assure that,

12.1. This Agreement has been validly executed and delivered by you and warrants your legal, valid, and binding liability, enforceable against you in regards to its terms;

12.2.You have sole power, right, and authority to agree to the terms and conditions of this Agreement and to carry out your responsibilities under this Agreement, without the approval of any other party;

You shall not hold any losses against All Time Design and its affiliate and subsidiary companies, directors, employees, licensees, successors, and officers from any and all compensations, damages, liabilities, fines, losses, costs, and expenses that arise out of misinterpretations, negligence, failures or misconduct of Affiliate.

All confidential information, including, but not restricted to, any business, technical, financial, and customer data, divulged by one party to the other during the effective term of this Agreement which is mentioned as “Confidential,” will remain confidential and both the parties will keep them in confidence at all the time and not disclose them without written permission of the disclosing party.

15.1. You accept that you are an affiliate and nothing in this Agreement will build any partnership, joint venture, franchise, employee, or sales representative between you and All Time Design. You will never accept any offers, favors, or benefits on our behalf. You will not announce anything officially on your website or other sources that would contradict anything mentioned in this Agreement.

15.2. Neither you nor we may assign the rights and responsibilities mentioned under this Agreement to any other party.

15.3. You agree to not make changes or waive off any rules of this Agreement unless you have obtained written consent from both the parties.

15.4. This is the recent Agreement between us and you and shall supersede all prior agreements and communications.
